Service of Process is useful when an individual, residing outside of the Dominican Republic, needs to officially inform an individual residing in the country of a legal process that is being carried out abroad. By notifying the party residing in the Dominican Republic they will be unable to allege ignorance.

In all cases, documents will be served by a competent bailiff in all Dominican provinces according to the general laws in the Dominican Republic. If the original document is not in Spanish eLexPersona.com will translate the document that will be served.

REQUIRED DOCUMENTS:

1. Copy of Cédula (Dominican identification document) or complete passport (if foreigner) of the applicant.

2. Copy of the document to be served.
Expenses related to document legalizations in your country’s consulate in the Dominican Republic will vary depending on how many documents will be legalized and the fees charged per consulate. eLexPersona.com has covered this fee, however if the expenses exceed the established amount, these will be charged separately.

1. How long does it take to serve a document?

Once the document has been translated, which will depend on the length of the same, it will be served in one day. If the document will be presented outside of the Dominican Republic it must be legalized by the corresponding institutions in order for the document to be valid abroad. The complete process takes approximately 7 business days.

2. What happens if the person to whom the document will be served is not present at his/her residence?
If the bailiff does not find the person that will be served, the document shall be signed by relatives, employees or servants. In case that no one is present, the document will be served to the neighbors who shall sign the document. The person will be considered legally served when the document is served in the residence or directly to the person mentioned in the document.

3. Is a document served by a bailiff in the Dominican Republic valid abroad?
Yes. If the document will be presented abroad it must be translated, if necessary, once it has been served. Then the document must be legalized by the Attorney General's Office of the Dominican Republic, the Ministry of Foreign Relations and the corresponding consulate. These legalizations are already included in the total fees for this service.
